Assessing capacity in the Court of Protection

The Court of Protection has issued guidance to experts who are instructed to prepare reports about the mental capacity of individuals. In a case involving a 68-year old with dementia the report of the consultant psychiatrist who was instructed was found to be insufficient. It is not unusual for experts' reports to be inadequate in this complex field so the guidance is very welcome.
