In the employment law world, decisions don’t come bigger than today’s Supreme Court decision on holiday pay which provides clarity over when underpayments form a ‘series’ and whether staff should be paid their normal remuneration for all their holidays, or just for their EU derived holidays.
The decision will have enormous consequences for the PSNI which owes tens of millions of pounds to staff for historic holiday underpayments, but it will also affect many thousands of employers all over the UK who will now be considerably more likely to find themselves on the receiving end of tribunal claims.
