FS hot topics: Commission disclosure - an update

On Wednesday 16 March 2022, we held the first webinar in our new FS hot topics series on commission disclosure.

It is now three years since the FCA published its final findings on motor finance, and almost a year since the Court of Appeal decision in the Wood and Pengelly cases. On the back of these developments, many lenders are now facing a barrage of claims from claims management companies (CMCs) and related law firms.

In this webinar, we provide a summary of key developments over the last few years, followed by an up-to-date review of recent activity and anticipated developments both at the Financial Ombudsman Service (where around 650 complaints are awaiting decisions) and in the Courts (where we are starting to see decisions emerging). We then move on to consider how the issue might evolve in the months and years ahead, before finishing with a discussion on what steps lenders should consider implementing in order to protect themselves both now and in the future.
