Melissa and Tom explain how a third party could have a right under a commercial contract even if they are not a signatory to it and how care should be taken when drafting to ensure that the contract does not inadvertently gives any third party rights or, where the intention is to provide such rights that is clear. In doing so they consider the importance of the Act and consider the risk of not referencing it in your commercial contracts.
