Ellen Hughes-Jones is a Legal Director in the Intellectual Property team, based in the firm's London office. Her practice covers intellectual property law matters, with a particular focus on trade mark and copyright disputes and the full spectrum of trade mark and design portfolio management (including brand clearance, protection and maintenance, global brand launches and re-structuring, and IP enforcement).
Ellen has experience dealing with anti-counterfeiting actions, pre-and post-publication advertising clearance, marketing regulation and compliance, and consumer promotional programmes, together with IP due diligence, audits, and preparing commercial agreements relating to the development and exploitation of IP.
Her clients include some of the world's best-known brands, including an American multinational technology company, a multinational payment card services corporation, and a successful technology designer. In addition to contentious experience, Ellen understands the commercial needs of her clients having been on secondment to a multinational pharmaceutical company, where she drafted and negotiated procurement contracts, licensing agreements, outsourcing agreements and clinical trial agreements.
Ellen’s experience includes:
• advising clients and enforcing rights in trade marks and copyright against infringements in the United States, United Kingdom and European Union
• managing a number of global trade mark portfolios, advising on all aspects of trade mark and brand protection, including clearance searches, trade mark prosecution and oppositions
• three years working on behalf of an industry association aimed at enforcing its members copyright by preventing software piracy and use of unlicensed copies of its members software. Following reviews of software audits provided by the 'target' companies, negotiating numerous settlement agreements in addition to encouraging compliance purchases of the infringed software
• playing a major role working for a large software development company in a dispute with one of its customers for alleged breach of contract
• negotiating terms on which several well-known sports brands can manufacture products so as not to infringe the client's rights and registered trade marks
She is a member of the International Trademark Association (INTA), and sits on the INTA Bulletins Committee.
World Trademark Review’s WTR 1000 2024 states that Ellen “does a fantastic job at managing trademark portfolios and resolving disputes for multinational brands.
